Please read these Terms of Use carefully before using HorseMart. They explain the rules for using the Website, what we are and are not responsible for, and what we expect from every Buyer and Seller.

1. About these Terms

  1. 1.1

    These Terms of Use (the “Terms”) are a legal agreement between you and HorseMart (“HorseMart”, “we”, “us” or “our”). They govern your access to and use of the website horsemart.in (the “Website”).

  2. 1.2

    By visiting the Website, creating an account, or posting or responding to a Listing, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Website.

  3. 1.3

    These Terms are published in accordance with the Information Technology Act, 2000 and the rules made under it, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. They are an electronic record and do not require any physical or digital signature.

2. Definitions

In these Terms:

  • “Buyer” means a User who views a Listing or contacts a Seller.
  • “Content” means any text, photograph, video, document or other material posted on the Website.
  • “Listing” means an advertisement for a horse posted on the Website.
  • “Seller” means a User who posts a Listing.
  • “User” or “you” means any person who visits or uses the Website, with or without an account.

3. Our role

  1. 3.1

    HorseMart is an online classifieds platform. We only provide a place where Sellers can advertise horses and Buyers can find and contact them.

  2. 3.2

    We are not the owner, seller, buyer, broker or agent of any horse on the Website. We do not take part in, and are not a party to, any negotiation, sale, payment, transport or handover between Users.

  3. 3.3

    We do not inspect or verify any horse. We do not guarantee the accuracy of any Listing; the health, age, breed, quality or legal status of any horse; or the identity, honesty or ability of any User to complete a transaction.

  4. 3.4

    As an intermediary under the Information Technology Act, 2000, we are not responsible for Content posted by Users. However, we act on complaints and remove unlawful Content as described in these Terms.

4. Eligibility and accounts

  1. 4.1

    You must be at least 18 years old and legally able to enter into a binding contract under Indian law to create an account or post a Listing.

  2. 4.2

    You must register with your own Indian mobile number and give accurate information. You must not create an account for another person or pretend to be someone else.

  3. 4.3

    You are responsible for keeping your password and recovery code confidential, and for all activity under your account. Tell us immediately if you believe someone else has used your account.

  4. 4.4

    We may refuse registration, or suspend or close any account, as described in section 10.

5. Rules for Sellers

  1. 5.1

    When you post a Listing, you confirm that:

    1. you own the horse, or the owner has authorised you to sell it;
    2. the horse is not stolen, pledged or the subject of any legal dispute;
    3. all details, photographs and videos are true, current and of the horse being offered;
    4. the health, age, training and other information you give is honest to the best of your knowledge, and you have disclosed any known illness, injury, pregnancy or behavioural problem; and
    5. you own, or have permission to use, all the Content you upload.
  2. 5.2

    You must keep each Listing up to date, and mark it as sold or delete it as soon as the horse is no longer available.

  3. 5.3

    You alone are responsible for complying with every law that applies to the sale, care and transport of your horse, including the Prevention of Cruelty to Animals Act, 1960 and the rules made under it, and any veterinary or health-certificate requirements of the Government of Tamil Nadu.

  4. 5.4

    To prevent spam, we may limit the number of Listings a Seller can post in a day.

  5. 5.5

    Posting a Listing is currently free. We may introduce paid features in the future, and we will tell you clearly before any charge applies.

6. Advice for Buyers

  1. 6.1

    Before you pay any money or take delivery, see the horse in person, check its documents and, wherever possible, have it examined by a qualified veterinarian.

  2. 6.2

    Never pay an advance, deposit or token amount to someone you have not met, or for a horse you have not seen. HorseMart never collects payments on behalf of Sellers and will never ask you to pay through the Website.

  3. 6.3

    Any agreement you make with a Seller is solely between you and that Seller.

  4. 6.4

    You may use a Seller's contact details only to ask about their Listing. You must not use them for spam, marketing or harassment.
